Keri, Dean Volecape has done sterling work here and seems to have discovered that in Irish law Tim Hathaway would be considered to be Ruairi's father. Borsetshire Blue thinks Irish social services would be bound to take an interest. This would clearly create considerable legal problems for Brian. Any comments?

We are long overdue a referendum to enable a change in the law, but they've had great difficulty getting the wording right and getting across the message about what is wrong with the currect legislation.
I'm sure the family lawyers and children's advocates would love a really withers-wringing case like this - maybe the trailers should be running on RTÉ.

Dean also mentioned in a post a few days ago, that DNA tests have no status under Irish law - which might also complicate things a little.

I have to confess I can't remember where Ruairi was born. Does anyone know what Ruairi's nationality is and does he have a British or Irish passport?
If he doesn't have a British passport then will there will be lots of red tape for Brian to cut through before Ruairi can reside in the UK ? Will this include some sort of probate for Siobhan's will ?

but tim isnt irish, so how would irish law effect him? and as other posters are saying,myson was born in england. much as i would love a right old kerfuffle about this, i just dont see it is at all relevant. and lets face it, tim has said his goodbye to siobhan (silently) and thats that as far as he is concerned ref the programme.

It's not the immigration aspect that's exercising me, Poppy, it's the fact that there must have been lots of paperwork sorted out off air if Tim is not to be considered Ruairi's father by Irish law. Yes, of course Tim won't be trying to get custody of Ruairi, but legally he could. A Fellow of the Institute of Chartered Nitpickers like me likes to know that these details have been considered and resolved.

Not only would Tim be assumed father of any child born to his then wife but he was dissuaded from naming Brian as co-respondent on the divorce petition in order to smooth things over speedily so there's no legal trail at all afiacs. Assuming that Brian is named as legal guardian and that Siob didn't change this for any reason Usha could be looking at a nice little earner defending Brian against Tim's petition to show that Siob was not competent in her last days.

If this were a TV soap, sorry, drama, nobody would give a stuff about all these little details. Characters are always doing things like emigrating to South Africa or Canada without even a hint of an entry visa or immigration requirements.

Surely Siobhan would have made a will naming Brian A as the father. Otherwise the fact that they were not married to each other and that Brian already has a wife in England would have made things very complicated. You cannot just take a child out of the country.
Haven't been following the story that closely but have we actually heard what the Irish granny has to say on the subject?
We havn't heard anything from Bridget. I really do think that she culd have been voiced - even if by "a member of the cast" - she seems pretty crucial.

agree, I think this would have added more to it - although I guess there is still time brian needs to go back there to collect ruari but i doubt they will do that now
