Ex-sailor Fred Minall, from Northampton, has missed out out on compensation for mesothelioma, caused by work with asbestos in the Royal Navy, by two weeks.
Mr Minall has long campaigned to get compensation and the government passed a law last month bring in compensation.
However, due to the time frame in which he worked in the Navy, he doesn't qualify.
